فساد و مقبولیت قانون

کتاب حاضر شامل دو بخش و یک نتیجه‌گیری است. بخش نخست در چهار فصل به علل و پیامدهای عدم مقبولیت قانون در چهار حوزه‌ی سیاسی، اجتماعی، فرهنگی و اقتصادی می‌پردازد. در این بخش، پس از بررسی حاکمیت قانون و درجه‌ی حق‌داری نظام حقوقی، به زمینه‌های اجتماعی قانون، سازگاری قانون با ارزش‌های عام و اقتدار عقلانی نظام حقوقی توجه می‌شود. در پی همین، اصول چهارگانه‌ی برابری در قانون مطرح می‌گردد.

در بخش دوم نیز، در چهار فصل عوامل مؤثر بر فساد در حوزه‌های چهارگانه‌ی جامعه (ازجمله نقش سرمایه‌ی اجتماعی، هویت اجتماعی، نابرابری و انحصار اقتصادی و سازوکارهای علّی فساد و عدم مقبولیت قانون در هر حوزه بررسی و در قالب شانزده قضیه‌ی محوری بیان می‌شود. ‌ ‌ ‌

  This book is structured into three parts and nine chapters. The main thrust of Part I is to explore the key characteristics of the four major sub-systems of society- polity, community, culture and economy- and their impacts on the legitimacy of law in the first four chapters. Part II investigates the cascading effects of corruption on political, communal, cultural, and economic systems of society in four chapters respectively. The last part of this volume draws the causal nexus between corruption and the illegitimacy of law, putting forward possible response strategies. With discussions bridging legal, sociological, economic and political theories, this book will be a useful resource for a wide range of audiences in different disciplines, such as Law, Sociology, Political .science, Economics, Development studies, and Public policy
